Our Feedback on the Implementation Framework for a Right to a Healthy Environment


The Manitoba Eco-Network (MbEN) has submitted comments to offer insights regarding the formation of an implementation framework that will delineate how the entitlement to a healthy environment will impact the regulatory procedures outlined in the Canadian Environmental Protection Act, 1999 (“CEPA”). The CEPA-mandated implementation framework will shed light on how the right to a healthy environment, alongside key legal updates like environmental justice and intergenerational equity, will impact CEPA’s complex regulatory processes. This presents a crucial chance for the federal government to enhance health and environmental safeguards under CEPA and improve access to environmental justice, particularly for vulnerable groups. MbEN emphasizes the significance of research, studies, and monitoring initiatives to support citizens’ environmental rights and the mechanisms facilitating their protection.

Over the last three years, MbEN has collaborated with Manitobans to advocate for meaningful legal and policy changes across federal, provincial, and municipal levels, aiming to safeguard vulnerable populations and enhance their access to environmental justice. Through projects like the Healthy Environment, Healthy Neighbourhood Project and Navigating the Law to Protect the Environment, MbEN gathered extensive feedback from Manitobans, highlighting the demand for increased access to environmental legal resources and enhanced public engagement opportunities. This submission draws on insights from these initiatives, as well as MbEN’s involvement in the consultation process for the current implementation framework. MbEN actively engaged with the implementation team through workshops and local events, ensuring Manitobans’ voices are reflected in the feedback provided.
